Platform Terms of Use
1. About These Terms
1.1 Who we are
Kool Labs ("Kool", "we", "us") runs Kool. Kool is a platform that helps you build and publish websites and apps by describing them in words. We are based in India.
These terms are a contract between you and us. They cover your use of Kool and all related services (the "Services").
1.2 Your agreement
You agree to these terms when you create an account or use the Services. If you do not agree, do not use the Services.
Our Privacy Policy explains how we handle your personal data. It is part of this agreement.
1.3 Changes
We may change these terms. If a change is important, we will tell you by email or in the Services before it starts. If you keep using the Services after that date, you accept the change.
2. Your Account
2.1 Who can use Kool
You must be at least 18 years old, or be allowed by law to enter a contract. If you use Kool for a company, you confirm that you can bind that company to these terms.
2.2 Keep your account safe
Give us correct information. Keep your sign-in details secret. You are responsible for what happens in your account. Tell us quickly if someone uses it without your permission.
3. Using Kool
3.1 What you may do
We give you a limited, non-exclusive right to use the Services to build and publish your own projects. You may not transfer this right to others.
3.2 What you must not do
Do not break the law. Do not infringe other people's rights. Do not upload malware. Do not send spam. Do not harass or harm others. Do not try to break into, overload or probe our systems.
Do not copy or reverse engineer the Services. Do not resell them without our written permission. Do not use the output to train a competing AI model.
4. Your Content and AI Output
4.1 Your content
You own the prompts, files and data you give us ("Your Content"). You also own the code and assets Kool generates for you, as far as the law allows. Third-party and open-source licenses may still apply to some parts.
4.2 Our license to use it
You give us a limited license to host, process and display Your Content. We use it only to run, protect and improve the Services and to give them to you.
4.3 AI can make mistakes
AI output can be wrong, incomplete or similar to what other users get. Check and test everything before you publish or rely on it. You are responsible for what you deploy.
4.4 Reports about content
If you think content on Kool breaks the law or your rights, write to us at [email protected]. We may remove content that breaks these terms or the law.
5. Plans and Payment
5.1 Fees
Some features need a paid plan. We show the price, billing period and limits before you buy. Paid plans renew by themselves until you cancel. You can cancel at any time in your account settings. Cancelling stops the next charge.
5.2 Refunds and taxes
Fees you have paid are not refundable, unless the law says otherwise. We may add taxes where they apply.
6. Third-Party Services
6.1 Connected products
Kool can connect to other companies' products. Their own terms and privacy policies apply to them. We are not responsible for their services.
7. Ending Your Use
7.1 By you
You can stop using Kool and delete your account at any time.
7.2 By us
We may suspend or close your account if you break these terms, if you create legal risk for us, or if we stop offering the Services. Where we can, we will tell you first.
7.3 After it ends
Your right to use the Services ends. Terms that are meant to continue will continue. These include ownership, disclaimers, liability limits and governing law.
8. Risk and Liability
8.1 No warranty
We provide the Services "as is" and "as available". As far as the law allows, we give no warranties of any kind, including for quality, fitness for a purpose or non-infringement.
8.2 Limit of liability
As far as the law allows, we are not liable for indirect or consequential loss, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability that the law does not allow us to limit.
9. Governing Law and Disputes
9.1 Law
The laws of India govern these terms and any dispute about them.
9.2 First, talk to us
If you have a problem, write to [email protected]. We will try to settle it in good faith within 30 days.
9.3 Arbitration and courts
If we cannot settle it, the dispute will go to arbitration under the Arbitration and Conciliation Act, 1996. There will be one arbitrator. The seat of arbitration is in India and the language is English. The courts in India have exclusive jurisdiction over matters the arbitration does not cover.
9.4 Consumers
If you use Kool as a consumer, you keep any rights that the law of your country gives you and that we cannot remove by contract. This includes your right to go to your local court or authority where the law gives you that right.
10. Rules for Some Regions
10.1 European Union and United Kingdom
If you live in the EU or UK, the mandatory consumer laws of your country still protect you. You may bring a claim in the courts of your country of residence.
10.2 India
If you live in India, the Consumer Protection Act, 2019 and the Information Technology Act, 2000 apply as the law requires. Send any grievance to [email protected].
10.3 California
If you live in California, you may contact the Complaint Assistance Unit of the California Department of Consumer Affairs in writing or by phone at (800) 952-5210.
11. General
11.1 Other terms
If a part of these terms is not valid, the rest still applies. If we do not enforce a term, we have not given it up. You may not transfer these terms to someone else without our consent. We may transfer them as part of a merger or sale of our business.
